God the US is utterly fucked. Can't see anyway you guys even start to go towards a more progressive nature, given anyone who has the gaul to have even a slightly "socialist" policy are utterly villainized.

sooo dumb this down a shade for me because i've only read light summaries but it sounds like they're saying confessions (or any evidence) disclosed in non-custodial situations is different and doesn't need to be mirandized? I thought that always was the case - anything you say to the cops is bad, all the time, forever, whether or not you've been read your rights? Not saying this is good, mind. edit: is there some nuance over what an "interrogation" is that I'm missing?

It’s not much solace, but it feels like this court will eventually have more of its decisions overruled by future courts than any other.

 

edit: yes yes there won’t be another court, the collapse of American democracy is nigh, heat death of the universe, etc. etc.

It’s not even hyperbolic to suggest that if you’re a straight white Christian who loves guns, this is the court for you. “Free exercise” + unfettered access to firearms is a license to do whatever you’d like.

Basically what it's saying is that a Miranda violation doesn't automatically constitute a 5th Amendment violation (because Miranda rights are meant to protect against 5th Amendment violations but they do not set the standard for whether the 5th Amendment is violated); therefore, establishing a Miranda violation is not, in and of itself, enough to sustain a suit under Section 1983 (which provides that government officers can be sued civilly for violations of constitutional rights). In other words, showing that an officer violated Miranda rights isn't enough to maintain a suit against the officer under Section 1983--you'd have to show something more. 

 

This quote from the opinion is probably the most succinct statement of the holding: "In sum, a violation of Miranda does not necessarily constitute a violation of the Constitution, and therefore such a violation does not constitute “the deprivation of [a] right . . . secured by the Constitution.” 42 U. S. C. §1983."

This is the exact kind of shit that happens when people say Trump wasn’t that bad. They don’t think about all the judges and people he put into place, all the way to the Supreme Court, that make these things happen. All of these cases started in lower courts and got kicked up to this level so they could become de-facto laws. That’s his legacy, not the fucking dumb tweets.

Think it’s the opposite actually. Get quite a few shitty decisions done today. Release Roe tomorrow and we immediately forget about the ones from today.

It's just exhausting.

 

I used to find solace in the fact that I would probably be very old or dead by the time things really fell apart, but now that I have a kid, a daughter no less, it's really really fucking depressing to see each of these decisions come out.

 

She is so fucked.
