Andy Carroll: West Ham seek legal route over red card

 

West Ham are to take legal action after failing in their appeal to overturn the red card shown to Andy Carroll during the 1 February win against Swansea.

The Football Association upheld the decision which means the England striker is now banned for three games.

"There is nowhere to go other than to seek some kind of legal redress," said West Ham co-chairman David Gold.

Rules allow clubs to take disputes to arbitration and if necessary to the Court of Arbitration for Sport.

The FA has refused to comment on the latest development.

Carroll, 25, was sent off after clashing with Swans defender Chico Flores during his side's 2-0 victory.

He will now miss the Premier League games against Aston Villa, Norwich and Southampton.

In apparent reaction to the decision, Carroll, who set up both goals tweeted: "Disgraceful."

According to the FA, West Ham failed to prove to a three-man panel that referee Howard Webb had made "an obvious error" in dismissing Carroll after the forward's arm hit Flores's forehead.

However, West Ham manager Sam Allardyce was certain that Webb made a mistake.

"There has to be somebody to look at that in the cold light of day and say that is certainly not a red card," he said after the win.

Gold added: "We are hugely disappointed at the outcome of the process.

"The last thing I want to do is going to some kind of legal issue because I think it is a footballing issue.

"But we are fighting for our lives. If we were mid-table we would probably get on with it but we are fighting for our lives to retain our Premier League status and we owe it to our fans, we owe it to ourselves.

"We are upset, we feel we have been badly treated.

"Most judgements are not made by three people, they are made by 12 - that's why they are called juries.

"I believe if you had gone to the FA Council and asked the 100 members 75% would have said it was not a sending off, but if you just take three people it may not be representative."

West Ham are 18th in the Premier League, one point from safety

 

I look forward to FIFA banning West Ham from all football. Don't they have a thing about not involving the courts in footy stuff?

dunno about FIFA but every single club signs up to not before each season to the system and not to bring courts into it, frankly I'd hope the rest of the clubs would work together and throw west ham out for trying it. What do they think makes them so special that they can get away with it, every single club had had bad reffing decisions every single club has had appeals go against them when they thought it shouldn't have. None of those have decided to throw their toys out of the pram and go crying over it. Christ its not as even if it was clearly wrong, theres enough in the rules for the incident to be a red despite Flores's crying like a 4 year old girl.

Apparently the FA are allowing a personal hearing tomorrow morning.  Hope they don't let them off as it will send out the wrong message.

not to mention opening the threat of similar action from every single club, it would basically destroy the suspension system as anyone who doesn't want a player banned, just scream loudly and shrilly enough and threaten to go to court and your player will get off scott free! And thats not even taking into account the outrage from other clubs near the bottom if West Ham get away with it really opening themselves to legal action there should West Ham stay up because of a goal from Carroll against Villa Norwich or Southampton

Hopefully someone in the FA has a sense of humour and has only invited West Ham in to waste their time.

 

Don't really see the difference between this and Remy - enough in both to be red, but both a bit harsh and both involved play acting defenders.

nope there was enough for a red imho despite Flores playacting much like the Remy incident stupid by the players to give the opportunity to be sent off.

Farcical decision to send him off vs Allardyce being miserable. Balancing act.

 

I didn't think so. I mean, I don't think he should have been sent off because it was certainly ambiguous, but Carroll's movement was such that it's understandable that the ref could see it as deliberate on the one look he got. Even after looking at replays I couldn't say with absolute certainty that Carroll wasn't a bit reckless, and didn't know Chico was there.

 

Chico cheated, and should be punished for it. I just don't think the red card was totally outlandish.

Jesus, that exact thing happened to me the other night after a bargy bargy tackle and we laughed it off and he said 'sorry mate'. Ridiculous Carroll got sent off :lol: wasn't even looking.

Carroll did swing for him so the red was deserved for the intent but like his shooting of late he was lucky he missed the target therefore leaving the colour of card in debate...

Yeah, I thought Carroll was being a bit cute. There's a lot of this accidentally-on-purpose elbowing going on in the game, and I don't mind seeing refs get a bit stricter.
