Isn’t it only APT that are subject to FMV rules? Surely if you remove the APT rules then the FMV rules are automatically irrelevant as there are not APTs? At the very least, even if we have lodged nothing APT wise to date, we can lodge as many as we like over the next month, and if the November rules are then declared null and void too, which most seem to think will be the case following the way they were rushed through, then we can then insist on using those at that point and maybe even use the potential threat of legal action when the next ruling comes through to get them allowed through immediately.
