I think it's far more likely that when traveling on holiday under the visa waiver program, he simply didn't declare that he had a record. It's not like its much different in the UK. But having looked into this whole visa issue, apparently the ESTA lasts for two years? If that's so, shouldn't be a problem with Barton getting a visa - business/pleasure reasons.
