Emre got charged and not banned didn't he? They charged him (Emre) immediately and then heard the evidence though, didn't they? This time they've taken a few weeks to assess things and do their own little investigation THEN charged him. Could be wrong like. The Emre incident was reported after the game in which it allegedly took place (Everton away). The FA announced a day afterwards that they were launching an investigation. Then a couple of weeks later, Emre was officially charged.

I could be flat out wrong here but it did look to me in the highlights that he pulled it in the run to get to the ball and not in the actual challenge. Probably, I could be wrong too. I'll have to see the incident again.
