Newcastle United lose Judicial Review against HMRC

Give the players named so far have been Sissoko, Cisse, Ba and Marveaux it's looking increasingly likely West Ham were raided just because they did a deal with us dodgy lot rather than it's something that affects all clubs and we're just the first to hit the press.

I'm no fan of Charnley but I do think his treatment by HMRC looks to have been excessive. I guess we'll just have to wait and see once the dust finally settles on this mess.

Seems unfair like,  information is coming out now,  i dont think we have anything to worry about.

I assumed that myself because of the Marseilles link, but I've not read it reported anywhere.

NEWCASTLE UNITED have launched a legal challenge over documents seized from the club by officials conducting a tax probe.

 

A High Court judge has banned members of the HM Revenue and Customs investigation team from examining, without the club's consent, material taken in a raid carried out in April under search warrants issued by Leeds Crown Court.

 

Mr Justice Supperstone, sitting in London, said on Thursday the ban would continue until resolution of the club's application for a judicial review against HMRC.

 

 

He directed that any material being retained by HMRC which is identified as attracting legal professional privilege must be returned to the club.

 

He also directed that the legal action involving the Magpies, who have just secured promotion to the Premier League, must return to court on June 22.

 

It is expected the club will then have to show that it has an arguable case to take to a full judicial review hearing.

 

At Thursday's interim hearing no details of the grounds of the challenge were revealed in court.

 

During the day, lawyers for the club did not respond to requests for further information about the case.

 

HMRC lawyers said they could not provide any information.

The seizure of documents from Newcastle United by tax officials may have been unlawful, a judge has said.

St James' Park and West Ham United's ground were raided in April by HM Revenue and Customs (HMRC) as part of an inquiry into suspected tax fraud.

The club applied for permission to seek a judicial review of the search-and-seize order HMRC had obtained.

A judge said it was "arguable" on several grounds the search warrant was obtained unlawfully.

Mr Justice Supperstone, sitting in London, said there must be a full High Court hearing of the issues.

Newcastle FC's managing director Lee Charnley was among a number of senior European football officials arrested in connection with the matter and later released without charge.

During the raids, business records and financial records were seized as well as computers and mobile phones belonging to the club, which recently secured promotion to the Premier League.

The HMRC investigation into suspected income tax and national insurance fraud centres on football agents and payments made in transfer dealings between English and French clubs.

It has confirmed the French authorities are assisting the UK investigation.

'Flawed warrants'

The judge ordered that a full hearing of the case should take place next month, probably over 27 and 28 July.

Newcastle United argued the warrants were excessively wide and there were no grounds to believe the club was engaged in suspected tax fraud.

Club lawyers also argued the legal procedures followed when the warrants were obtained at Leeds Crown Court were flawed, and no proper reasons were given.

The judge said the absence of reasons made it harder for him to be satisfied the warrants were lawfully issued.

He continued orders preventing HMRC officers from examining the seized material pending the full hearing.

The HMRC said it would be "inappropriate" to comment at this point.
