I don't actually understand why these arguments - which are to be made in private - need to be made at all. I thought this was purely about whether or not the CAT had jurisdiction, so surely that's purely an argument about process, rather than anything to do with our relationship with the PL during the failed takeover?

NUFC would have known this confidentiality risk from the start - as soon as Ashley took on the PL through two legal fronts. Always a risk of prejudice on content of simultaneous proceedings.

What's arbitration actually for then? To decide whether KSA is a director or not? If so there's no chance we win that.

Yeah I assume your right there, Or to arbitrate that the KSA doesn't need to be down as a Director from the PL's point of view. So not to argue if they are or not, to argue that obviously they are but they don't need to be?
