Toffs use the 70's and 80's club crests - not sure if they've paid for the priveledge, or if the older crests are just open for usage once they are no longer 'current'. I would guess with the current crest, you could be seen as trying passing something off as the current shirt, hence not allowed, but the older are always going to be 'retro' or different.
