Newcastle United lose Judicial Review against HMRC

Does this mean we have to play full strength teams in our remaining games in the hope that we get enough points to absorb any deduction?  Or if we're due a 5 point deduction and that wouldn't make a difference to automatic promotion, would they just roll it over to next season?

 

“If any club becomes subject to or suffers an insolvency event, that club shall be deducted 12 points.

 

“If a group undertaking of a club becomes subject to or suffers an insolvency event, then the board shall have the power to impose upon the club a deduction of 12 points scored or to be scored in the League competition.”

 

The points would be deducted when the club becomes subject to any insolvency action. If this is before the fourth Thursday in March, the deduction is applied straight away.

 

If it is after the fourth Thursday in March, the club will start the next season on minus 12 points.

Oh fuck, we are going to get screwed here aren't we. Would be just our luck to take a points deduction which knocks us out of promotion, West Ham also take a points deduction and they get relegated, saving Sunderland's arse.

How come you pay less tax on money you get for image rights than you do for playing football anyway? Surely whether you're getting paid for scoring a goal cos you're a good footballer, or getting paid to model the new training gear cos you're a good footballer makes no odds? Or is your image sold as a product like a painting you'd done and cos VAT is lower than the top rate of  income tax it works out cheaper?

Total investigation is said to relate to five million in unpaid tax.  Not likely anyone will be made insolvent?

This won't be decided for fucking ages mate.

 

HMRC don't do anything quickly and then you've got the endless court hearings, appeals, more hearings, more appeals etc.

 

Look into the Rangers case - that started in 2012 and is still ongoing.

Let's hope they've done exactly the same as us, cos there's nee way the FA would let the Premier League be decided on a points deduction.

 

Probably why they've made a polite information request rather than raid Chelsea's offices.  Give them some time to get their story straight.

Polite request = Hi, we are coming for you for tax fraud, but Ray who is my boss supports you and doesn't want bad stuff to happen. If you could give us all your computers and such so we can look at, it will be greatly appreciated. I must stress that it is important that you don't delete any files on there that may incriminate you, but don't worry if there is, Ray will cut you a deal. If you have any dirt on other clubs then feel free to highlight those documents for us, put them in it's own folder if you want. Could you do this by next Friday, or the Friday after? If not then Ray will come down and deal with the situation, and it would be appreciated if a few players could be there at the time of his arrival as he will be bringing his son and daughter Terry, and Chelsea along with him and they are also big fans.

So is this a problem in France, with French clubs not declaring or paying the correct tax etc???

If that was the case then Charnley wouldn't have been arrested as he would have done nothing wrong. It is likely to revolve around OM, and Charnley facilitated them in doing it.

Anyone sum up what has happened, just got in from work and saw the headlines?

Us and West Ham raided for some sort of tax fraud regarding image rights and such. Chelsea have been politely asked to hand over things instead, how that works is beyond anyone. Charnley has been arrested, his home and the training ground have also been raided. Others have apparently been arrested but I think everyone else who has been arrested are in France. It seems to resolve around the former board at OM.

The raids are understood to be part of a wider HMRC investigation into the transfer of players between clubs in France and the UK.

 

It is thought their focus has been on remuneration in terms of image rights, benefits in kind and payments to agents, which may have defrauded the public purse.

 

Surely there was a rabbit away when Sunderland paid nearly £14m for Didier N'Dong??!!!
