Probably hoping the tribunal will cut him short which, if the decision goes against the PL, will probably give the PL adequate grounds to appeal on the basis they werent allowed to fully argue their case ,and so they will kick the can down the road!!!

I think they really really dont want anything to be public, if there is a threat of dirty laundry being aired then I think the goalposts move signficantly (ie CAT goes ahead)

Does anyone know what his/CAT starting stance is? Do the PL have the convince him to throw it out or do we have to pursade him that their is a case to run?

Burden of proof is on the claimant in civil cases.
