I get where you're coming from, but the PL would say that they're an established company with a wealth of experience and knowledge in that field and that's likely to be accepted without much question by any court, as it was by the arbitration tribunal in relation to their assessment of sponsorship deals from UAE businesses.

Man City have seemingly increased there sponsorship deal as a direct result of the arbitration. There is no way a uk company can assess a company from Saudi or UAE. We will find out better when the new rules are agreed (if they actually are)

433. The evidence revealed that Nielsen has a very high profile in the field of football club sponsorship deals. Indeed, MCFC has itself instructed Nielsen to provide advice on valuation. It must also have been known to the clubs that Nielsen had a confidential proprietary database. The evidence revealed that it is called SponsorGlobe and that clubs may, by the payment of a fee, obtain access to SponsorGlobe, as MCFC apparently did.

 

437. We are persuaded that the system as a whole is fair. In particular the club will have received a copy of Nielsen’s report with the Board’s Provisional Determination and have had an opportunity to comment on it. Thus, in the particular circumstances of this case, it is not unfair that a club is deprived of access to, and therefore the ability to comment upon, the detail of the transactions assessed by Nielsen to be relevant and comparable.

Nielsen are a global business who asses media and ad spend all over the world

 

Personally I think FMV for football sponsorship is fundamentally flawed, as sponsorship in sports can sometimes be based more on emotion and kudos than return on investment

 

If I win the lottery and want to pay £100m to put "BobbyDazzla (Fastest Dancer in Newcastle)" on the front of NUFC shirts because it'll make me an absolute legend then it's clearly not FMV, but why should I be stopped from doing it 

 

But when it comes to assessing the value of sponsorship from purely a financial viewpoint, Nielsen are experts

Man City didn't accept the sponsorship value though that's the whole point and Emirates top bloke came out stating exactly what I said earlier

You wouldn’t be assessed for FMV, because you’re not an associated party of the NUFC ownership, only sponsorship deals that are from associated party’s are subject to FMV. If Petronas for instance were to come in tomorrow with a £100m per season sponsorship deal, it would sail through and not even be assessed for FMV

That would be my suggestion, maybe £100m per season from Ethiad for NUFC and £100m per season from Saudi Air to Manchester City

I know that, I was just using it as an example of emotion and kudos overruling balance sheet when it comes to sponsorship decisions 

 

It wasn’t a full analysis of how the FMV process works 

 

But just for the record, if I do win the lottery I am sponsoring the shirt with “BobbyDazzla (Fastest Dancer in Newcastle)” for £100m. You can quote me on that
