Fuck it, I'll take the job on I'm bringing Ben Arfa back, putting a three of ASM, Miggy, HBA behind Wilson Hayden and Willock dominating the midfield Willems and some random Right Back I'll pick up supporting Fed/Lascelles and LeJeune at the back I'm fucked if we get injuries as I've no back up plans and the tactic is to fucking attack at speed and put the little white thing in the big white thing more times than the opposition

The plus for the consortium with someone like Howe compared to Rafa is that he would be more open to an overarching structure managing the club and facilities whereas Rafa would be in on every meeting. Not saying Rafa's approach is wrong in any sense, but you could see why new owners with lofty ambitions would steer away from him.
  3. IT's not interesting that they made the disclosure, they had to. There is zero chance that the PL auditors were not aware of the claim and they would have made damn sure it was disclosed before signing off the accounts. Chances of winning or losing don't come into it, it's a matter of fact that the litigation is there. The bit on not having any liability can be two fold, wither (a) they believe that there is at least a 50.1% chance of being successful or (b) they believe that if they were to lose the penalty would not be financial - i.e. remedy would be for the takeover to be approved. How the conversation would have gone is Mr Auditor 'What do you believe the payout would be, and do you have anything to support that' Masters 'We haven't reached that stage, we are strongly contesting the CAT stream and believe that arbitration is the forum to resolve this. The outcome of arbitration will be that either we were right in how we dealt with it last year (and this is our position) or we have to rerun the tests just on the disclosed directors. There is no financial liability in play here.   4. Mbabu was pretty much a perma crock when he was here, yes the talent was evident but it was in the balance as to whether he'd make it at a high level. He had to go back to the Swiss league to rebuilt his career, hardly a no brainer to keep him at the time. We also don't know how much was left in the kitty at the end of the Championship summer, for all we know it was a choice of Gamez and Gayle or a different right back and no stirker. Didn't Janmaat make it pretty clear he wanted to leave once we went down?

  6. It's impossible for 20 teams to all do the right thing. There is all innovation and movement in the way the game is played and unless every player was an exact equal, every manager is an exact equal and every club does everything the same way there will be a 'wrong' way to do things. I'd say rather than it being that an owner doing it right makes relegation impossible it's more a case of its actually easier to run a club in a way to stay up than it is to get it so badly wrong that you get relegated. Of course for a newly promoted club sometimes the best thing is to come up, go down and pocket the cash and then come back up again. Ashley has done everything that would be on the 'do not do' list and even he has only managed 2 relegations in his time here. That's quite an endorsement on how badly other clubs get it

  13. You could just as reasonably argue that the move to arbitration being offered was due to the buyers refusing to give a full reasoned response. There's a bit of supporting evidence (for either side) missing when just taking the letter. Reading through the last few pages here, I'm not sure that arbitration will be around F.1.1.1. As you say on page 910 there is no reference to what happens if the PL do not respond within 5 days and the wording of F.4 (which feeds into F.1.1.1) sets out what happens for people put forward as directors should they fail. So arbitration has to be centred around the phrasing of F.4 and the term shadow director - who are the PL to overrule Saudi law in defining a shadow director? If we can win on that point then it becomes a seemingly straight forward path to passing the test. The CAT action is also going to concentrate on F.4 and not F.1.1.1, only this time it will be on whether the PL gave assurances or indicated that the proposed board would be accepted only for it to then change it's mind following interference from other clubs or partners. It will be the actions of others that will win or lose us this case - and if we prove that competition law was breached through using F.4 to stall the takeover then for arbitration you can bypass the legal definition of a shadow director and whether UK Company Law prevails by showing that the PL were happy not to consider KSA as directors or owners. You then go straight to F.4.1 and F.4.2 on the submitted directors My guess is that the case for interference leading to the collapse of the test is stronger than the case for forcing the PL to accept Saudi law on shadow directors.

Bruce must know that (a) balance of probabilities say he won't get an extension to his contract here, (b) his 'stock' will never be higher now with a 12th place finish to fall back on. So it comes down to does he take the final year of the contract knowing that there is a risk that this will be it for it or does he put the feelers out for a top half championship club to see if there is a 3 year deal on offer there (what's his standing at Sheff Utd these days :-)) Or the wildcard, does he stick it out hoping that Dyche picks up another job and Burnley becomes available.

He probably thinks he can do the same with football managers - hang them out to dry with the pressure from fans and assume they will just sack it off.
