That’s fair enough at the bidding part of the process. It’s agreed and in approval stage. I don’t think legally he can withdraw, he’d risk losing the club completely.

I genuinely admire Ashley if he do so. I mean, the counterpart is THAT guy. He could lose his life due to this.

Unless exclusivity has been and gone. That's an issue.

 

I'd imagine exclusivity is probably separate to the contract so may not be linked. So whilst in negotiations there would be an exclusivity period, and then a separate defined period post contract signing where funds have to be transferred.

 

E.g. when you sell your house you have sold STC which I'd see as the exclusivity period.

Then you exchange contracts and completion is X amount of weeks/months later.

Surely exclusivity is irrelevant now? The deal will be done, contracts signed, subject to PL approval. That’s it.

The only way he can surely back out is if the funds aren't transferred by a defined date. It's locked down and signed - no other loop holes.

It isn't really. The exclusivity relates to negotiations. When the deal was agreed a contract will have been signed agreeing the sale. So essentially once PL approve (we hope) all PiF et al. would need to do is pay the money and they can complete. All the exclusivity ending means is that Ashley has the right to negotiate with others, it doesn't remove PiF's right (given to them by the deal contract) to complete.

 

That's why I'm hugely sceptical of any claims the Owners & Directors Test has been passed and 'it's not the obstacle'. Firstly, just can't see a legal way Ashley would be able to block and secondly, I think the idea that everyone involved in the deal (including the PL, Ashley, Stevely, PiF and associated clingers on) could keep their mouths shut that the PL has approved it is very unlikely. We'd almost certainly have heard something from a 'mainstream' media outlet - many of whom seem to have sources who are varying levels of close to the deal.

Qatar will, out of sheer spite, loan him the money until after the O&Ds test is passed. He'll then pay it back by leveraging debt against the value of the club like the Glazers did with Man U.

 

We'll be fucked for decades of that happens, but to suggest Mauriss can't raise the money is inaccurate.

Again, missing the point.

 

He doesn't have to. He just has to convince Ashley to sell to him so he pies the Saudis off. He probably would fail the O&Ds test but by then the Saudis will be utterly fucked off with the whole thing and incredibly unlikely to come back in. Qatar's only aim is to scupper the sale to the Saudis, not to actually get Mauriss in.

Which is why right now he's gone radio silent, so his lawyers have a chance to look through the contract and see if there's grounds to cancel the deal. He'll only cancel it if he can, maybe there's a way for him to do it and maybe there isn't. None of us have seen the contract so we cannot know.

Do you really think that Staveley/Reubens/PIF would not have that covered that, especially after Staveley's episode with Ashley the last time? These are people who sign up to contracts in business all over the world and frequently.

A exclusivity agreement is used to allow a buyer to do due diligence and generally give them time to sort out the deal without the worry of another buyer coming in.  Once the deal is all signed (which this was months ago) exclusivity ends and the legal terms of the signed contracts take over.  In other words the exclusivity agreement isn't relevant anymore.

 

Could there be a part of the agreed deal that allows for breaking that deal if money isn't fully transferred by a certain date?, of course.  Would the buyers sign such a deal knowing that effectively that time frame is out of their hands and with a third party (The Premier League)?, I seriously doubt it.  There's also no evidence at all that any such clause exists.  Instead people (like Edwards) are just acting as if the standard exclusivity has continued after the deal was agree, that doesn't happen.

I don’t mean to be pessimistic but Surely GM would be able to gage by the conversation wether the info he was told Was positive or negative and going by his tweets his take is thats Ashley is holding it up in a negative Sense??
