A judge would decide that, he can ask permission to leave the country and it's then down to whether he is regarded as someone who would refuse to come back, as to whether permission is granted. Also the fact he hasn't been charged yet makes it even more tricky. And he may have no restrictions at all, depending on what his bail conditions are.
