Takeover Thread - July 1st statement, Staveley letter to Tracey Crouch (and response) in OP

Recommended Posts

Just seen the BBC touch on the Joshua fight set for Saudi. To be fair they did touch on some of the controversey around it. Infuriatingly this ammounted to nothing more than how hot it was going to be. No piracy, human rights, grieving widows, protests, dissent, Yemen, sports-washing....you know all the stuff that gets dredged up for our proposed takeover.

Why are we seeing a letter dated October 2020

Because it sets out the basis of NCSL's original anti-competition case, which the club has now taken on because (probably rightly) the PL responded to that saying that NCSL didn't have the legal standing to bring the case.

The case included that beIN's letter objecting to the takeover was anti-competitive and that the PL had a legal duty to report both it and the reported lobbying of other PL clubs against the takeover to the competition authorities, and publicly distance themselves from it.

If that is the case, it looks like the PL might be screwed.

Just read the Athletic article from Slater/Waugh. Seems inevitable at this point that we'll be starting and ending the season with Ashley and Bruce. Truly a miserable thought but just seems like the most likely scenario given the timescales of CAT and arbitration. I always feel enthused by the fact that the fight is ongoing, but God it feels like we're as far away from a resolution as we've ever been.

Imagine it doesn't go our way, that means starting 2022/23 with Bruce/Ashley as well, and an extremely uncertain future as he either settles back in or starts looking for any chancer who'll take it off his hands.

Ho hum.

I won't be starting another season with Bruce or Ashley.

Aye, it's looking thoroughly depressing at the moment.

Particularly bleak when we all know he'll renew Bruce midway through next season with a long contract.

The current predicament is complete misery. Ashley, Charnley, Bruce, Media coverage, the hopelessness. Fucking sick.

Think of the profit we'll make on ASM and Wilson though. Won't you think of the profit goddammit!

Yeah, it's absolutely horrendous. I think I've settled on the fact that Bruce is the worst of it. I was inconsolable when Rafa left; there was no one thing that was keeping me away, just thoroughly disgusted with the whole situation. But as the pain from that has wilted slightly - really I think it's probably just Bruce which poses the biggest obstruction to me feeling at least something. I know if we appointed a better manager it would still be a lie, and I'd seriously question the new man's own integrity and pedigree, but at least I don't think I'd want us to lose every week.

It's broken now though, there can never be another encouraging manager under Ashley. He'll just be a sticking plaster and if he has any ambition he'll eventually be forced to quit.

I guess it's possible you might get a young manager who's good and wants a shot in the PL, then he can use us as a stepping stone and not stay through too many transfer windows.

Apparently the Premier League have been granted an extention of time until 17.00 hrs on June 5th 2021 to contest Mike Ashleys CAT jurisdiction

Where did you get that from?

Quote

IT IS ORDERED THAT: The Defendant is granted an extension of time to file and serve its application to contest the Tribunal’s jurisdiction until 5pm on 11 June 2021. 2

REASONS

1. The Defendant seeks an extension of time to 15 June 2021 to make an application, with supporting evidence, challenging jurisdiction pursuant to Rule 34 of the Tribunal Rules (“the Jurisdiction Application”) on the basis that the Jurisdiction Application will involve detailed submissions and supporting evidence that the Defendant is preparing alongside current procedural deadlines in arbitration proceedings with Newcastle United Football Club, which are said to cover materially identical issues to those raised in the Claim and which are being heard on an expedited basis in July 2021.

2. The Defendant also considers it necessary to have sight of a confidential addendum filed by the Claimant with the Claim in order to finalise its Jurisdiction Application. The Defendant considers that it will suffer clear and obvious prejudice if required to submit its Jurisdiction Application and all of its supporting evidence by the 14-day deadline stipulated by Rule 34(4) of the Tribunal Rules and states that the Claimant has not identified prejudice to it by the requested extension.

3. Having considered the confidential addendum, I am not persuaded that the Defendant is unable to prepare its Jurisdiction Application without sight of that document which, as the Claimant submits, sets out the calculation (using commercially sensitive information) of the current estimated quantum of loss and damage on the basis articulated in the Claimant’s claim form. I also note the Claimant’s arguments that the Defendant was made aware of the Claim in December 2020 and had intimated since as early as February 2021 that it would challenge jurisdiction and that the Defendant will need to progress both procedural deadlines on the arbitration and work on the Jurisdiction Application in parallel.

4. However, in light of the concurrent arbitration procedural deadlines, there is good reason why the Defendant requires additional time to prepare what it indicates will be detailed evidence in support of the Jurisdiction Application. As present, it is not known whether the Defendant will be granted the separate extensions of time which it is currently seeking from the arbitral tribunal but in any event the extension which it is there seeking for disclosure is to 26 May 3 2021, which is also its current deadline for filing its evidence. Whether or not it is granted an extension for filing evidence to 9 June 2021 as it has requested, I consider that it can prepare that evidence in parallel with its evidence in support of the Jurisdiction Application. I do not see that the Defendant will be prejudiced by a limited extension. Taking all this into account, I consider that a slightly more limited extension of time to 11 June 2021 is appropriate and justified.

The last part of reason 1:

urrent procedural deadlines in arbitration proceedings with Newcastle United Football Club, which are said to cover materially identical issues to those raised in the Claim and which are being heard on an expedited basis in July 2021

Is this definitive proof that arbitration has not started yet but will be done in July??
